Terms of Service
These Baltic Solutions Terms of Service are mandatory for all Baltic Solutions customers.
Important! If you are planning to use our services, you must read these rules and you must confirm that you have read, understood and agree to these Baltic Solutions Terms of Service
before account registration in our websites and placing your order. If you created user account in our system, or placed order, then this means you confirmed that you have read, understood and unconditionally agreed to our Terms of Service.
1. CUSTOMER ACCOUNT CREATION AND SERVICES ORDERING
1.1.By placing order, customer undertakes to provide true and correct his contact and billing details.
Baltic Solutions is NOT providing anonymous services, this means, that we are not accepting anonymous orders placed via proxy/VPN/TOR or with incorrect/false contact/billing details. You can read our
Privacy Policy here.
1.2. To prevent fraud and abuse, all new customers orders is checked by Baltic Solutions security team. Also, new customers orders can be checked in a third party abuse/fraud databases (ex. maxmind.com and others). By placing order with us, customer unconditionally agrees, that his order can be checked by all methods provided above.
1.3. In case of any doubts regarding customer's provided contact/billing details correctness, Baltic Solutions reserves rights to request from customer any additional proof documents to confirm customer's identity, address and billing information, etc. If customer does not provide requested documents, then Baltic Solutions reserves rights to not provide services for such customer.
1.4. If order not passed anti-abuse/anti-fraud/security checks, then it is marked as high risk order and is rejected. In this case Baltic Solutions reserves rights to not provide services for this order. If payment for this rejected order is already received, then this payment is refunded back to the same source (bank account, Paypal, credit card etc). If payment method does not allows to make refunds and in case of any other technical reasons or needs, Baltic Solutions reserves rights to offer customer refund via other payment methods.
1.5. Baltic Solutions reserves right to not accept new placed orders without any
Baltic Solutions reserves the right, in its sole discretion to refuse the new order with the absence of any reason for denial. In that case, if payment for services already received, it is returned to the client as well as stated in 1.4. section.
1.6. If customer violates these Terms of Service, we always try, whenever possible, to inform our customer about the violations and what steps need to be carried out urgently to eliminate the violations immediately, but if we receive legal abuse complaint and/or detect any abusive or Terms of Service violating activities, we reserve rights to block abused/affected service without prior notice.
2. ALLOWED AND PROHIBITED ACTIVITIES AND CONTENTS
Baltic Solutions services can only be used for legitimate purposes and for legitimate content hosting. It is strictly prohibited to use Baltic Solutions for any illegal, unlawful or ill-minded things. It is strictly prohibited to use Baltic Solutions services for any copyright violations. Customer agrees to indemnify Baltic Solutions from any third-party complaints, claims or damages/losses/compensations associated with the customer's activities and/or hosted contents in Baltic Solutions servers or provided via Baltic Solutions services.
2.1. EXPRESSLY PROHIBITED ACTIVITIES AND CONTENTS:
2.1.1. Any copyright violations. Illegal copyrighted works or materials distribution, reproduction, broadcast, granting access to such material by using Baltic Solutions services is strictly prohibited! Including such prohibited things as warez sites distributing pirated software, pirated mp3 and other formats of music distribution, distribution of pirated books, pirated film distribution, reproduction, broadcasting or grant access for all other copyrighted works illegal distribution.
2.1.2. Cryptocurrency mining activities.
2.1.3. File sharing or indexing programs, services, or sites such as Torrent, DC ++ RapidLeech, eMule and other is strictly prohibited.
2.1.4. Cracked programs, archives, scripts and content management systems distribution.
2.1.5. Passwords and serial numbers sharing.
2.1.6. Public anonymous proxy service is prohibited in our servers (proxy, vpn, tor, etc.).
In VPS server or in Dedicated server, you can install and use only
private (non-public) proxy for personal use and for legal own needs
2.1.7. Any activities related to TOR is strictly prohibited.
2.1.8. Any kind of erotic and pornographic sites are prohibited. In case of illegal pornography (bestiality, child pornography, etc.) affected services will be blocked immediately and such customer will be reported to the law enforcement agencies.
2.1.9. Investment and fraud sites such as HYIP (High Yeld Investment Programs), Ponzi, PTC, and the like.
2.1.10. Gambling and betting websites.
2.1.11. Camfrog services and programs.
2.1.12. Illegal - pirated CCcam Cardsharing services.
2.1.13. Unlicensed or illegal drugs, narcotics or weapons distribution.
2.1.14. Illegal or unlicensed financial services, exchanges, banks, payment systems, and so on.
2.1.15. Virus or malware distribution.
2.1.16. Any malicious/abusive activities: hacking, cracking, phishing, fraud, scanning, DOS, DDOS, Flood attacks, Booter/Stresser, botnets, etc. Any unauthorized connection to another computer, another computer system, or computer network, any unlawful misappropriation of information, or attempt to do so is strictly prohibited.
2.1.17. Any spam, mass, junk or bulk mailing is strictly prohibited! If detected, then affected service is immediately and permanently blocked!
2.1.18. When sending mails it is prohibited to change/fake/hide original sender's address or identification.
2.1.19. Extremist, offensive, defamatory material dissemination/distribution. Any hatred, hate or retaliation promotion. Violence, force, racism, dissemination/promotion, or any activity prejudicial to the public, a group of persons, or a single individual.
2.1.20. IP/ARP spoofing.
2.1.21. HitLeap or any artificial traffic creation.
2.1.22. It is prohibited to use Baltic Solutions servers or Baltic Solutions services for unlawful, illegal activities, which violates Republic of Latvia, Lithuania laws or European Union laws.
2.2. SHARED HOSTING LIMITATIONS AND PROHIBITED ACTIVITIES:
2.2.1. In a shared hosting servers there is hosted a lot of customers and websites, so shared hosting services are only appropriate for a small and medium web sites with low CPU and MySQL resource needs. If your site is popular and it uses a lot of CPU, RAM, MySQL resources, then this site we recommend to host in VPS server or Dedicated server, where all server resources will be dedicated to you and your website needs.
2.2.2. Baltic Solutions reserves rights to restrict or temporarily block customer sites in a shared hosting servers, if these sites overloading server resources and/or disturb working for other customers sites in the same server. In this case, we recommend moving to VPS server or to Dedicated server.
2.2.3. Any activity related to the IRC in shared hosting servers is strictly prohibited.
2.2.4. It is prohibited to host websites and perform other actions in a shared hosting servers sites that uses a lot of shared server resources.
2.2.5. It is prohibited to host ads banner rotation sites, files, or photo storage/sharing sites (like rapidshare, and so on.), use shared hosting plan exclusively for a files storage purposes.
2.2.6. Any mass mailing is strictly prohibited in our shared hosting servers.
2.2.7. For our shared hosting customers, we are doing and keeping daily backups, so in case you will accidentally delete your data, it is very likely that we be able to restore your up to 7 days (week) old data, but Baltic Solutions does not guarantee that the data will be restored, you must always make and keep your own offsite backups for your important data. Baltic Solutions is not liable for a loss of customers data and the related potential loss/damages regardless of who suffered that loss/damages.
2.3. VPS SERVERS LIMITATIONS AND PROHIBITED ACTIVITIES:
2.3.1. We offer unmanaged (self-managed) VPS servers. This means, that VPS server will be fully managed by the server owner. We are not providing any server management services and help regarding server management, including all services/programs running inside customer VPS server. VPS server owner have to fully manage his VPS server, install all custom software, perform updates and upgrades and keep own VPS server secure.
2.3.2. We are not making and not keeping any backups for our unmanaged VPS servers plans. In all our VPS nodes we are using RAID arrays to avoid data loss in case of hard disk failure. But in some very very rare circumstances there is small risk of data loss. In case of dataloss (hardware/software fault and other reasons) Baltic Solutions does not guarantee that the lost data will be restored, so you must always make and keep your own offsite backups for your important data. Baltic Solutions is not liable for any loss of customers data and the related potential loss/damages regardless of who suffered that loss/damages.
2.4. DEDICATED SERVERS LIMITATIONS AND PROHIBITED ACTIVITIES:
2.4.1. We offer unmanaged (self-managed) dedicated servers. This means, that dedicated server will be fully managed by the server owner. We are not providing any server management services and help regarding server management, including all services/programs running inside customer dedicated server. Dedicated server owner have to fully manage his dedicated server, install all custom software, perform updates and upgrades and keep own dedicated server secure.
2.4.2. We are not making and not keeping any backups for our unmanaged dedicated servers. Baltic Solutions is not liable for any loss of customers data and the related potential loss/damages regardless of who suffered that loss/damages.
2.4.3. In case of permanent 24/7 100% dedicated server CPU usage, there may be additional charges added to the server price.
3. PAYMENTS FOR SERVICES, SERVICES RENEWALS, CANCELLATIONS AND REFUNDS
3.1. Baltic Solutions services are activated only upon receipt of payment
3.2. Baltic Solutions services renewal:
3.2.1. Baltic Solutions customers is obligated to pay the bills for the services renewal no later than the end of services paid periods.
3.2.2. If customer wishes not to renew his service, he must initiate a service cancellation at the end of paid period, or contact Baltic Solutions customer support and inform us about service cancellation. If customer not initiated cancellation for the services and not informed Baltic Solutions customer support about service cancellation, then is considered that customer wants to keep/renew his service, so he is obligated to pay service renewal invoice.
3.2.3. Overdue services blocking and termination due to non-renewal:
3.2.3.1. Shared Hosting services and VPS Servers blocking and termination due to non-renewal:
3.2.3.1.1. If customer does not pay VPS server of shared hosting service renewal on time, then overdue service is suspended after 1 overdue day. In that case, suspended service can be unblocked only if we receive renewal payment for this service.
3.2.3.1.2. If customer does not pay VPS server or shared hosting service renewal for 7 overdue days, then outstanding service is irreversibly terminated/destroyed and after that can not be restored even if we receive payment. Important! Baltic Solutions does not store backup data for terminated/cancelled/deleted VPS servers and shared hosting plans, so data restoration after the service deletion/termination/cancellation is technically not possible.
3.2.3.2. Dedicated Servers renewal, blocking and termination due to non-renewal:
3.2.3.2.1. Dedicated Servers 1 month renewal period is 30 days and does not depends on how many days is in current month.
3.2.3.2.2. If customer does not pay Dedicated Server renewal on time, then overdue Dedicated Server is blocked on the due day and then, at any given time, may be irreversibly terminated. In case of overdue Dedicated Server blocking we cannot guarantee that server can be restored even if we receive late payment. Overdue blocked server restoration price is 20EUR.
3.3. Early services cancellation and payments refunds policy:
3.3.1. Early VPS Servers and Shared Hosting services cancellation and payments refunds policy:
3.3.1.1. If customer is not satisfied with Baltic Solutions VPS Servers or Shared Hosting services and from the day of service activation passed no more than 14 days, then service may be cancelled and partial or full refund issued to such customer.
3.3.1.2. If customer requests early services cancellation in accordance with Section No.: 3.3.1.1. and wants to get full refund, then Baltic Solutions reserves rights to not provide any new services for such customer in the future, because of high risk of early cancellation without compensation.
3.3.1.3. If customer requests early services cancellation in accordance with Section No.: 3.3.1.1. and wants to receive partial refund with used days and all payment administration costs deducted from the refund amount, then such customer may at any time in the future order Baltic Solutions services again without any restrictions.
3.3.1.4. If customer uses our VPS server or Shared Hosting services for more than 14 days, then it is considered that Baltic Solutions services fully satisfy this customer needs and customer agrees to not stop services at least until the end of the current paid period.
3.3.2. It is not possible to get refund for a services listed bellow not matter for what reason:
3.3.2.1. Domains registrations.
3.3.2.2. SSL Certificates.
3.3.2.3. Installation/activation costs (if there was such kind of costs involved).
3.3.2.4. CPanel control panel licenses.
3.3.2.5. DirectAdmin control panel licenses.
3.3.2.6. Dedicated servers.
3.3.2.7. ISPmanager control panel licenses.
3.3.3. Not all payment methods technically allows to refund payments. Below is listed payment methods which does not allows to issue refunds:
3.3.3.1. SMS payments.
3.3.3.2. Paysafecard payments.
3.3.3.3. Yandex.Money payments.
3.3.3.4. Sofort banking.
3.3.3.5. Safety Pay.
3.3.3.6. cashU.
3.3.3.7. Bitcoin and other cryptocurrencies.
3.3.4. In case of refund there may be all payment and refund administration and back/payment fees deducted from the refunded amount.
3.3.5. If service has been blocked due to abuse, malicious, fraudulent activities and/or Terms of Service violations, then payment for affected services is not refunded.
3.3.6.
All customers disputes/claims/refunds and services issues has to be resolved directly with Baltic Solutions. Any customer claims/disputes for Baltic Solutions services which was rised/opened/resolved not directly with Baltic Solutions, but through payment system/processor (credit card-issuing bank (chargeback), PayPal (dispute, claim), and so on.) is considered as fraud, and this creates all the associated consequences for such customer.
4. UNLIMITED (UNMETERED) DATA TRANSFER SPECIFICATION AND FAIR USE POLICY
4.1. Unlimited (unmetered) data transfer specifications for
VPS Servers and Shared hosting plans:
4.1.1. By default we offer unlimited (unmetered) shared 100mbps network line for all our shared hosting plans and VPS servers. Important! Network speed 100mbps is NOT guaranteed. Real network speed depends on total shared network line load by all other VPS servers and customers in the same node, so speed may be slower. If customer's site or VPS server constantly uses a lot of network line resources, and this cause slowness and problems to all other customers hosted in the same node/server, then Baltic Solutions reserves rights to limit affected/overloading VPS server or website speed or network packets rate (network packets sent/received per second rate, rate limiting) to protect other customers VPS servers or websites.
4.2. Unlimited (unmetered) data transfer specifications for
Dedicated servers:
4.2.1. By default we offer unlimited (unmetered) 100mbps network line for all our Dedicated servers.
5. DOMAINS REGISTRATION AND SSL CERTIFICATES TERMS AND CONDITIONS
5.1. Domains registrants have to read
Domains registrants rights and responsibilities, which is valid for a domain registrant if he register domain name.
5.2. Because of our Domains and SSL Certificates registry legal jurisdiction limitations (USA), we cannot offer/provide Domains registration and SSL Certificate services for an orders placed from these affected countries: Cuba, Iran, North Korea, Sudan and Syria.
6. LIABILITY
6.1. Client (customer) is fully responsible for all activities, sites or data stored/performed in ordered server or via ordered service, even if these actions was performed not directly by the client (customer).
6.2. Client (customer) is fully responsible for all his accounts with Baltic Solutions, for his contact details validity and for accounts passwords etc. Customer have to use only safe, strong passwords all the time and not provide login details to a third parties/persons, because customer will be fully responsible for all their actions performed in the customer's accounts and servers.
6.3. Baltic Solutions is not responsible in any way for a customers, websites and/or third parties actions or omissions and the potential losses, regardless of who and for what reason the losses occurred.
6.4. Baltic Solutions is not responsible in any way for a software or hardware failures and possible customers data loss and/or possible lost income or losses. Baltic Solutions users, customers, and visitors agree to use Baltic Solutions services assuming all the risks and possible losses associated with this.
Use Baltic Solutions services at your own risk.
6.4. In case of password loss, customer can reset his password by himself in the automatic password reset forms. Important! For a security reasons we are NOT accepting email addresses or any other customer details changes requests
received via email or via any other untrusted methods where we cannot fully identify requested person, so you have to use your main account email only from trusted and reliable email providers to not to lose account in case your main email mailbox will be lost.
Please remember, that you can change your account main email addres ONLY, if at first, you successfully login inside your client area.

7. Baltic Solutions TERMS OF SERVICE VALIDITY AND CHANGES
7.1. These Baltic Solutions Terms of Service are valid for the entire period of active services.
